ok me and my ex were never married but i left him and moved back to my moms house about 3 years ago. Now i live with my fiancee and currently dont have a job. I have been filling out all kinds of applications but i havent heard back from any of them. I live in texas and i have heard that judges tend to give mothers custody i dont know about any of that though. My ex is a firefighter and has a fiancee that he has only known for a couple of months. They know have a morgage together. His fiancee has a 5 year old child of her own. The first day i brought my son home from the hospital i was very tired and upset and i said some things about his mother that he didnt like so he pushed me down and i fell on my stiches. This is considered abuse. We share time with our son every week so that time is equal. This is the current situation. If anyone has any good advice please help.

You will probably go on sharing time. You should have filed assault when he pushed you down, it is too late now to rely on that to hope a judge gives you custody. |

I am a bit confused. Why are you trying to get custody after all these years? Is he an abusive or neglectful parent? Do you have proof that he and/or his fiance have placed your child in some type of danger? Are you able to provide a safe and nurturing environment for your son? How will you support your son without employment? If you do gain employment, who will provide day care? These are some of the many questions that will be asked by the court if you file for sole custody.
Furthermore, the fact that you suddenly decided to file for custody after your ex became engaged to someone else makes it look like you are just being vindictive. You have to think about what is best for your son, and if he has a good father, then you should not try to interfere with that relationship. |

Usually the woman has custody unless they're extremely abusive or an addict. I know a woman that's on 5 different meds for mental problems and she has custody of her kids. Her ex husband is a cop.

What happened between you and him doesent really matter since it was 4 years ago, I would say just go for it! Take him to court, if he lives in the same town or nearby it shouldnt be an issue. Obviously the kid is being taken care of at your house or he would have something to say already about it. |
