I know you need to file at the court office but does a third party have to mail the response to who ever is suing me? Please help I'm confused.

You normally both file your response with the court and send a copy to the other party or parties. You don't need a third party to do that. |

It depends on what state you are in. You should include that for any legal question.
In California, generally you need to have somebody else who is over 18 and is not a party to the lawsuit serve the response. Once the response is served, then the person who served it needs to prepare a "proof of service" which is sent to the Court, telling the Court when, how and by whom it was served. The summons should tell you if you need to do this, or direct you to an office, telephone number or website where you can get more information.
As with most legal questions, the answers usually depend on the laws and rules of the particular jurisdiction or state, and sometimes they can be very different depending on which state or jurisdiction you are in. It is usually helpful to consult a lawyer licensed in your state, and your local or state bar association can put you in touch with one. Many will even consult with you for the first time free of charge, or for a relatively inexpensive fee. |
