Not sure where to ask this question, but here goes.
My mother died recently. What has to happen for her estate to be probated? Does this happen automatically, or are there steps I have to follow?
Sure could use a little help here, thanks in advance!

If you are a sole heir, you can file an Heirship Affidavit. But if you have to probate, you'll need to get an probate attorney- they start at like $1500 to probate a will. |

It will make your life easier to speak to an attorney about this. The more assets your Mom had, the more of an issue this is.
If her assets were held in a trust, then you can bypass probate. |

You will have to send out notices to people who owe and to whom money is owed to. You inventory everything. It's not that hard like for a home you say kitchen stuff worth about ___. You make sure that everyone involved gets there share of the assists. Are you getting paid for this? It will take most people about 30-45hrs of their time so I hope your getting paid for it. There might be more and I'm sure the rest will tell more than I did. |
