I am scheduled to go to child support court soon. My husband was never issued an order by the judge to pay any set amount, but the state is suing him nonetheless. He makes very little as a waiter, whats the minimum he will need to pay? Do CS hearings take long? What do they ask, say? Will others be in the room? What hearing is more difficult divorce or child support?

Your state will have what's called a 'little blue book' of laws/rules and requirements for each parent which are referred to when going to court for child support/ visitation issues. You can ask for a copy at your clerks' office, I believe. To decide on the amount of child support, there will be a formula. You may be able to access it online and estimate the amount yourself. Check with your state site. The amount earned by each parent (or the amount they are capable of earning if unemployed or underemployed) is entered into the formula, some deductions may be taken into account and the amount determined that way.
If the two of you get along, there will be no need for attorneys. The CS court is simple and if you have questions, the judge will let you ask and will answer. No others will be in the room. Divorce is more difficult, I'd say, because the guidelines for child support are clear and simple. Good luck. |
