How is Texas Immigration laws Different from The federal Governments laws?

I know the Fed Govt has the primary responsibility to enforce immigration laws. im just wanting too know if there are any differences between the two at state and national level. i cant seem to find any clear cut difference in my research. I know the state can control drivers licenses and some social benefits but i really need some help in finding some key differences and please i don't want no personal opinion's about how you agree or disagree with immigration i just want facts and need help because i have a public policy paper due soon, any help would be appreciated thanks

It is not just enforcement, all immigration laws are federal and there are no exceptions, never has been. What the states are doing is authorized under their local vehicle code requirements (proper identification etc).

Additionally, no federal law provides that states must give benefits or identity cards to undocumented workers except to provide for certain things like emergency health care and lower level public education (Through K-12).

Federal law prohibits the state of Texas (and all other states) from prohibiting undocumented children from attending school.

This occurred with a case arising out of Texas (Plyler v. Doe) where state of Texas tried to stop the education of undocumented aliens in public schools. Supreme Court said: Texas was without authority to do so, children were without fault and we did not want a group of second class citizens.

U.S. Supreme Court further reasoned that many of the children were potential citizens (would become one day). This is why states cannot deny an education at the lower levels, many states also allow college education.

You must read: 457 U.S. 202
Plyler v. Doe link provided below.

No. 80-1538 Argued: December 1, 1981 --- Decided: June 15, 1982

The states have no immigration laws. If the Feds want to repeal all immigration restrictions and open the borders, the states have nothing to say about it.
