I personally think that they should be given some discretion, but in the end, the office should be consistent. You don't want some offenders getting "sweet deals" from one prosecutor while another offender who does the same thing in the same city not be offered the same deal simply because his case unfortunately (for him) landed on the desk of a harder prosecutor down the hall. There has to be a nice balance. They have to have some degree of discretion, because no two cases are exactly identical. But there also needs to be guidelines in the office so that there is consistent prosecution standards. |

There are DAs that try to establish uniform policies but they always fail miserably for the simple reason that every case is different. Whenever you think you have a comprehensive list of everything that should be considered in every possible situation, then next case will have some factor not on the list. |
