This 1mx1m thing is made of heavy plastic. It caused me severe pain for 3 days and I have 2 witnesses. This incident happened in a club in australia.

Sue for the cost of the medical attention, and any lost wages due to missing work. If you have soft tissue damage that won't heal, sue for pain and suffering.
If it did no damage, and caused no loss of work, and it was a complete accident, you will likely not win.
You have to consider "actual damages" and "punitive damages". If no actual damage was done, then no actual award can be given for that. If no law was broken, then no punitive damages can be awarded. Neglect is usually grounds for punitive damages, but it would have to be proved.
The damage was minimal, you're better off trying to get them to settle for around $5000. That's usually the insurance amount, and many places will settle that out of court. |
