i was involved in a hit and run accident. i followed the driver and he later turned himself into the police department. there was 2 poodles, 1 baby, and an adult passenger in the car. His insurance is going to give me an offer soon, how much should i be compensated for pain and suffering ONLY?

That will depend on how badly you were injured, and how much suffering you endured. If you were mildly injured and suffered only a few bruises and/or muscle aches, then you probably shouldn't expect anything. If you were seriously injured, suffered lacerations and/or broken bones or worse, were hospitalized, were prescribed pain medication or had to undergo surgery, then your demand should be commensurate. What you ask for and what you get also depends on whether or not you have a lawyer who knows how to wring as much as possible out of the insurance settlement. |

Pain and suffering (General Damages) is your physical injury. Special Damages is the financial losses, which is the cost of going to physiotherapist, travel costs, damage to vehicle, loss of earnings.
It is impossible to know what will be awarded to you because it would depend on what the medical report states.
We can assume liability has been admitted if he has reported himself to the police. Causation will however still need to be proved.
Minor injuries are approx £1k. However, if very minor then under £1k.
Upto 12 months soft tissue injury to neck, shoulders and back (whiplash) - £1-2k.
The costs of medical report and obtaining medical records are a separate cost which will be dealt with by your solicitor. |
