How often can a Judge adjourn a trial?

I was informed that i would be going to trial in a very serious lawsuit in a few weeks. however my attorney's office has just contacted me and stated that the judge has adjourned the trial to a couple more months! This is crazy. I've been waiting for over 2 1/2 yrs for this case to go on. Can this judge do it again? What is the likelihood he will adjourn the case again and what usually will make a judge do this? Serious answers only please. Thank you.

This is not technically an adjournment, since that takes place after the trial has started. This is a delay or continuance. There can be as many as the judge deems necessary. Usually they are in response to one side or the other filing a motion for one. If it's not your side, your attorney should be able to argue against the motion from the other side. If the judge is doing it on his/her own, I'd have my attorney look into it farther. Of course, the last thing you want is to piss off the judge, but I understand your need to get on with it. I'd bet that in spite of what your attorney is telling you, they are "in" on the continuances. If they aren't arguing against them, they are agreeing to them, passively at least.

This can be annoying, but there are usually good reasons. If the judge continued the case on his/her own, it was likely because another case or matter that was either a) more urgent, or b) even older, than your case was also scheduled for that time. Frequently, three or four cases are all set for trial at the same time, in the hopes that all but one will settle. Because almost all civil cases do settle before trial, this is usually an efficient method.

But when cases don't settle, then the judge has 3 cases all set for trial at the same time. The judge has to make a judgment call about which case is more important to get to trial sooner. In my experience, most judges choose the oldest case. So if yours has been there for 2.5 years already, there is a good chance that the judge won't continue it anymore.

Also, like the other poster said, it's possible that the judge continued the case based on a motion filed by your attorney or the other side. Talk to your attorney and make sure that your attorney is not filing motions to continue.

However, as far as the legality of it all, the judge can continue the case a couple more months, and could even continue it again. In the court I work at , we have a 3 year list, which means that cases should not last over 3 years. (it seems amazing, but most cases do take a very long time if they go all the way to trial).
