my son is 12. my daughter 10 and another 8 in the state of iowa. i have 3 kids all live with ex. he is actively in contempt cause he had denied my visitation and communication for the last two months.

Each state has their own requirements. Here in Texas, the age is 12, but we still have to go petition the court to modify the custody decree, and that is AFTER the court agrees that the child's choice is in the best interest of the child. So, it is not automatic just because the child becomes of age. |

In Michigan, I do believe its 14.
But if he's doing something that's against the law, you could take him to court and you might end up with the children, unless there is some underlying problem with you that's worse than him breaking the law. |

it varies from place to place anywhere from 12-18, but in any case a judge can always overrule the child so they can't have the choice |

Frankly, it really won't work like that unless everybody (both sides) are getting true justice. It's a rare thing indeed that two parties are being cooperative with each other.
The law and courts have their own ways of doing things state to state.
I feel sorry for American people left in the hands of family law in the U.S. It is truly a hidden from the masses pit of hell for many who go through it.
The courts are dispicable and corrupt as can be and play 'god' and it's heart breaking. They follow the custody issue and whose got the money.
The other issues they use are so full of garbage how they destroy people it's not worth the time to write them down. |
