we live in aptments and they guy below us. he has a guitar and surrond sound all day long we hear his tv even over our own.. he plays his guitar at like midnight so much its getting irritating it even wake us up..
we have told the manager and she has told him many times to tone it all down.

well today we were watching a movie and his tv was so loud we could hear the man's voice on his tv..so instead of calling the manager i asked my husband to just kindly ask him to turn it down so he will not get into trouble with her..

he went down and ask the that guy got so mad saying he has to listen to us walk around up here so we should just deal with it..i don't mind if its low but when i can hear it over my tv i think thats to loud no matter what time it is right?

well he finally turned it down about an hour later.. but now its on again and louder..its 10 pm here!!!

is this just something we will have to deal with or is there a way to stop it?

Almost all communities have noise ordinances/disturbing the peace laws. Some communities have more stringent ordinances than others and in some they are more strictly enforced.

Living in an apartment always presents more of a problem but you shouldn't have to live with habitual intrusive noise, especially after hours.

Because you have already discussed the situation with your manager and the neighbor, call the non-emergency number for your local police and ask about the specific ordinances in your community and how they apply to your situation.
