How to file a motion to withdraw a guilty plea in Utah?

My friend took a plea deal yesterday out of being scared. How does he reverse this? His lawyer is not repersenting him as she should be. She told him to take the deal cause they won't win. In the first place what lawyer is going to say that? And second she didn't fight or do anything.

If his own attorney is telling him he can't win; he can't.

In that case, she still negotiated the best plea agreement she could for the client.

Attorneys will win if they can; and they will fight if there's any chance they'll win. That's why she became a criminal attorney. The adversarial process is part of her personality.

At any rate, the lawyer works for him. All he has to do is insist she file a motion to withdraw. Just don't get your hopes up. In the US, ninety percent of requests to withdraw guilty pleas are rejected.
