You must, by law, give him/her a 30 day notice to vacate, regardless if there is a lease or not. I know it sounds absurd but if you give him a notice to leave less than 30 days they can turn around and sue for an illegal eviction.
Assuming this is a roomate situation.

Johnny is correct. If you've served them with a legal (court ordered) eviction you can then have it enforced with the assistance of the police if they still refuse to move out.
