How to stop a wage garnishment on child support?

I owe back child support and my employer has been served on me a wage garnishment that will make it impossible for me to live. I don't dispute that I owe back support, but the amount they have is not correct....This case has travelled thru 4 states, initially started in Arkansas in 1986, then Oh, Ky, and I live in West Virginia. No one has the any info on how that amount came about. I have made several phone calls to various county clerks to find out this info, but always to be referred to another state with the same reply..... appreciate any quick responses this on how this can be stopped until the amount can be settled and adjusted to what should be correct. If I need a lawyer for this, what kind of attorney should I contact to handle this?.....Thanks

Honestly, you have been a deadbeat. There is interest. There is nothing that will stop it until you catch up. You need a family law attorney.

I agree that 23 years of back support is going to generate a PILE of interest, as it should. It sounds like you've been a deadbeat for a very long time. Odds are the amounts have been ordered without your input, simply because you've been managing to avoid it. You chance to dispute the amount was when it was originally ordered back in '86.

Now you just pay until it's paid up (including all the interest that will come up in the future).

To dispute this at all, of course you'll need a lawyer, one with experience in family law.

By the way, you're lucky you have an understanding employer. I've know several who choose not to have deadbeat dads on their payroll.

Once the garnishment order is served it's too late to stop it.

The amount is so high because compound interest has been accumulating for 23 years.

To illustrate, let's say you were $1,000 in arrears in 1986, and have been underpaying $500 a year since then. We'll assume compound interest of 5%.

After 23 years, the debt would rise to over $24,000

Am I missing something? If your child support started in 1986, your child would be a minimum of 23 years old.

The case may have traveled through 4 states, but only the latest order is effective, unless the prior orders were in arrears.

You can address the latest order in the state is was issued in. There is nothing you can do about arrears.

Your employer should be able to tell you what state is garnishing your wages. that state is the one the most current support order is out of. You need to call the clerk of courts and ask how to obtain the court order. Once you get that you need to file a motion to modify child suppport in that jurisdiction. It's going to take a lot of phone calls and a lot of talking to stupid people who don't know what they are doing on the phone but it's worth it. If all else fails, call a family law attorney in your state and they can do it for your.

Nothing can "correct" it since it sounds like child support has been on your heels for years. Had you paid and reported where you were, only one office would be involved. Child support can reduce how much is taken from your check but you sound like you are making excuses. You don't get information about child support from a county clerk, call child support directly and talk to them.
