I'm I doing something illegal?

Okay, here's the low down. i'm 13 and wanted to take pictures for the yearbook. Some of my guy friends came out with me at recess and starting posing with the football. One of them posed in this REALLY tooty, fuity,(no offense to gay people) embarrassing way and I took a picture. I was tempted to put it in the yearbook, but offered to sell the rights to the picture to him for $20.

Is that legal?

if it were true, he owns the rights to his picture already, then how would the paparazzi make money? I think you guys are wrong on that fact alone.

Nobody would ever prosecute you for this, so the legality doesn't really matter. It's immoral as hell, but I love it! Seriously though, you've got to weigh the temporary financial gain against the ill-will you'll generate by doing this, an important lesson for someone like you who faces a promising future as an entrepreneur. Absolutely. If you took the picture than you owned the rights to it until you sold it to him.

If you were on assignment for the yearbook, with film paid for by the school, you do not own it. The school or the yearbook company does. And the procedure you used was definitely extortion.

No. Many magazines buy pics of celebritys for huge money without the celebritys consent. What you are doing is completely legal. Great Job!

Unless you had him sign a model release before you took the picture, you do not own the rights to the picture so what you are doing by charging him $20 not to puiblish it is blackmail and it is illegal. Check who won the Michael Douglas/ Catherine Zeta Jones wedding picture lawsuit against the National Enquirer.

Technically, no, because you have to get a signed release from him in order to claim the picture for yourself in the first place. No signed release, the picture cannot be published.

Probably not. If you really want to mess with him, instead of asking him for permission to use the picture in the yearbook, ask his parents... sounds like he's probably a minor too and can be overridden by parental consent
