My girlfriend's ex-roommate is suing us after she moved out and we did not pay rent because we did not stay there. The real situation is that our applications were denied by the apartment complex, the apartment complex did say a 3rd roomate applying (which we told the ex-roommate would be our friend, as we thought) or a co-signer would get our application accepted. Our potential 3rd roommate decided he did not want his name on the lease and we could not find a co-signer. The ex-roommate's name is solely on the lease, gas bill, electric bill, etc. The lease was never signed over due to our rejected applications and there is no agreement in writing, just a verbal agreement. Yet the apartment complex is siding with her in court. Does she have a case? Should I hire a lawyer? And if I don't, do I stand a chance in court if she does?
Any help is greatly appreciated!

Sorry, I didn't clarify that we did live there with her for a period of time with the ex-roommate. Our name was not on the lease though. When we tried to transfer the lease over to our name, that is when our applications were denied.

The apartment complex shouldn't have a leg to stand on as they rejected you and you didn't live there. You had no legal agreement with the complex and therefore they can't make you pay. As for the ex-room-mate, if she was the only person to live there and it was only her name on the lease, I expect she will NOT prevail at court. Two more things. 1) she is suing you in small claims court (most likely) so there won't be a lawyer present; and 2) talk to a free legal clinic or spend the money to talk to a lawyer for an hour to reassure yourself that you should be ok. |

well the court Sistem cant not go by he said she said their has to be a written contract or proof of some sort so if ther is not one ther is no potential case |
