Is it legal for me to hand out my tenants personal information which the census workers persistently ask for? Can I use my Fifth Amendment?

First of all, your fifth amendment is to make it so you can't be forced to testify basically against yourself.
Census workers are allowed to collect information from parties they believe to be reliable after trying repeatedly to contact the household.
You are under no obligation to open your files for this. In fact, I wouldn't without permission or a trip to your attorney. You may say the number of people you believe live in the apartment from memory. That's what they really want, a number. |

Of course you can't plead the fifth amendment. The 5th only guarantees that you cannot be required to incriminate yourself in a criminal matter.
Don't worry about it..... Even if the true answer is "I have dozens of illegal aliens packed like sardines into each one-bedroom apartment, and there's no electricity or running water.", it's still not self-incriminating, because the census bureau can't pass that info on to any law-enforcement or code-enforcement body.
You are safe from being prosecuted for any crimes you are committing in the way you run the complex based on what you tell the census.

Fifth amendment is in regards to a criminal case in which you can't self-incriminate yourself. It has nothing to do with the census. If you are not comfortable with giving out personal information about your tenants then don't do it, or ask the tenant what they wish... or even yet ask the census worker how the people can get in contact with them, and if you want provide that information to your tenant. |

i recently had a census person visit my place and i wasn't there, but my brother was....the person allowed my brother to answer the questions. not sure if it was because he is a family member, or if anyone can answer for anyone else. |
