I am being hounded by a debt collection agency on behalf of the child support agency how can i stop this?

Firstly,you can't get rid of a collection agency.Secondly,you need to add what state you're in,or country!Thirdly,if you can't get a job,there may be interest and it's just going to add up.If you are not physically or mentally able to get a job,then you need to apply for gov't assistance such as SS or disability.

PS-I can't believe you'd even complain on such a forum as this,you should expect some nasty yet very true comments,so I will refrain form stating the obvious.You think if a mother could not work and had no help,she would not be obligated to feed or take care of her child??You need to make a way,and pull your weight,now,before it just gets worse.Time to grow up.

...One of the most frustrating situations custodial parents can face is where the parent who is supposed to pay support becomes unemployed or simply never holds a job. The federal Constitution (the 13th Amendment) prohibits slavery and courts have, by that prohibition, been prevented from ordering non-custodial parents to work. Illinois law, however, permits judges to impute to an obligor the income he or she could earn. Thatâ€™s right, the judge has the power to direct the obligor to pay support commensurate with a wage he or she could earn if employment were sought in an occupation for which the obligor is trained and has the present ability to perform. The court may also order unemployed persons owing child support to keep a journal of their job search efforts and even to force them to report to at least three different job search services, work training, and work programs.

Even incarcerated parents have an obligation to support their children. Illinois courts have held that to relieve incarcerated parents of their child support obligations would let them profit from their crimes and unfairly insulate them from their responsibility to their children.

Where a parent is unemployed, underemployed, or has an income stream insufficient to pay adequate child support, it is sometimes possible to attack other assets â€“ bank accounts may be seized, real estate may be levied upon, and other assets may be taken for a Sheriff's sale. Courts may even impose QDROs on retirement accounts to collect past due child support. Where an obligor parent sponges off friends and family, or receives large sums of money claiming it to be "loans" rather than "income," there are still ways that child support may be enforced.

Go be proactive and look it up in your own state.

ALSO, YOU CANNOT DISCHARGE CHILD SUPPORT IN A ******* BANKRUPTCY!ONCE A JUDGE ORDERS YOU PAY,THAT'S IT,YOU PAY..... TO THE OTHER IDIOTS WHO SAID THAT.YEAH TRY TO LOOK UP THE UCC AND COONTRACT LAWS TO GET OUT OF YOUR COURT ORDERED OBLIGATION TO YOUR KIDS!!GOOD PLAN!!!!

Get down to your local Citizen's Advice Centre/Bureau and get their advice. They can probably draft a letter to the CSA explaining the situation.

Of course, if you are being chased for monies owed BEFORE you went out of work, they'll probably take it from your benefits at x-amount per week.

The CAB will also be able to help you contact the Debt Collectors and straighten matters out there.

Although some of those debt collectors are arrogant to a fine point.

I had one company hound me for a debt to which I had no connection. See trying to tell them I was not the person there were looking for? A solicitor's letter took care of that...

they wont stop chasing you, until you pay the bill, make a offer to pay them something, or go to your local citizen advice office, they will help you, all the best

Get a job, get your girlfriend's family to look after her and start paying your way as far as the children are concerned.

Pay the debt .. they are your kids .. why should we all pay for them ?

You will need to have the CSA, discharge the amount that they claim that you owed, i.e. the amount that is wrongfully claimed by the agency. And then pass on that discharge of debt to the bill collectors. Basically you have to contact CSA and tell them that the "debt" was in fact a book keeping/personnel failure(remember the person that you will deal with will not know the details of your case, so tell them everything), and have them release you from the burden of that debt, get it in writing!!!! Then you take the release form(remember every state has its own legal mumbo jumbo) to the Agency and thus prove that there is no actual/lawful collectible debt between you and them.

You can also go the: "I am not a contracting party to this debt and thus am not responsible for the contractual arrangement that you and CSA have between you" route, but that is tricky and gets real hairy.
Try the first idea first, and if you decide to go the second read and understand the U.C.C's.

Work out a payment plan, would you really miss $20 a week and as far as i know (here is oz anyway) filling for bankruptcy will not wipe your child support debt.

Allow them to take you to court and tell the Magistrate your problems and allow a repayment scheme of say Â£1 a week to be paid.
Or file for Bankruptcy and then they have to wipe the debt out.
Otherwise get a job and start paying them.
Do not however just ignore them, write a letter to the company explaining situation and indicate a full action plan of income, outgoings and money left at end and offer to pay a percentage of that money to the bill until such times as you can pay back more.

if you are getting nowhere with csa try the DSS explain to them whats happening regarding csa money although they do take Â£5 per week off income support to pay csa - from past experience with csa be calm when talking to them and explain the situation.

The best thing to do is contact the CSA asking if they are the ones that have instructed the debt collectors to chase you. They may not be connected in any way and could be fraudulent. You need, of course, to prove that you are unemployed to the CSA. As you say they cannot have the money if you don't have it but they can take your belongings. I am afraid this country has lost it's senses when it comes to money.

on free credit reoprt.com you can get a free report. If it's worng, which in your case is, you can report it as being wrong and they must get back to you in 60 days on the status.

try contacting the CSA again and explaining what is happening and ask them to write to the debt people telling then to back off and the reasons why.
