Alright, so I bought an eight week old chihuahua through a lady selling chihuahuas the fall of 08. I paid $200 (cash) for her, but only so little because the puppy didn't have it's shots yet. So it's been quite a few months later, and I now don't own a chihuahua, but a mutt. Here is a pics of her:

My "chihuahua" is actually a mix, the vet thinks a dachshund. This dog is over 12 lbs and twice the size of my 11 year old chihuahua - in lenth and width!
Am I able to get half my money back through the courts? I still have the seller's cell number and her work address. I also have my bank statement showing the only transaction for that day was a $200 withdraw. I love my dog, but I am infuriated that I was scammed by a real estate agent, for a dog!

-I was told the chihuahua was $200 because she didn't have any shots.
-I want to keep my dog.
I'm only asking for partial refund because a mix wouldn't cost that much.

You could sue the seller for misrepresentation...if she definitely told you the dog was a chihuahua and you relied on that statement to part with your money, then you could sue her. You should at first write to the seller, tell her the dog is not as she represented it to be and you want a full refund (in which case she is entitled to ask for the dog back!) If she doesn't play ball, tell her you'll see her in Court. (This has got to be one for Judge Judy!) |

Hello , I just look at your pics and I have the same dog years ago. You have a mix of chihuahua&mini-pincher.I had mine for 13 years and past away 2 years ago.They are lovable pet and my kids love him. Enjoy your pet. |

Do you want the money or the dog?
If you want your money back, give the dog back and vice versa.
If you wanted a purebred chihuahua you weren't going to find one for $200. You know that. |
