U cannot sue simply because it is an immoral and an unlawful contract which is opposed to public policy and which is unenforceable.
Just suppose you had a premise to sue for such an act. Would you be ready for the showdown in the open court. She can even claim that you are an impotent person therefore you need to be sent to medical examination. There are many aspects which can be raked up by your gf, if you are bent upon taking such issues in the open.

You can sue any one for any thing.
The result usually depends on credibility of the evidence and the rules of evidence.
Most contracts are best if they are in writing but verbal contracts are enforceable.
In certain cases only, contract must be in writing, otherwise the court will not allow the hearing.
But.
Again in certain cases.
In USA all real estate contract must be in writing only. But keeping with the nature and location, still some judges will entertain some verbal contract cases. It is up to the judge.
Most lawyer will stay away from such cases or collect enough up front fee explaining that they will file but if judge refuses to hear the case the plaintif will loose the money spent on the filling fees and other cost involved. |
