I go to work, get assaulted, call police then get terminated because I did. Wheres the justice in this?

My co-workers ganged up on me and lied, said I did things I did not do. Instead of doing what I was accused of which resulted in my termination I chose to call police just in case. So much for that protecting me. This same person hit me before and management did nothing about it, I even had a witness. This time the witness was the manager on duty. That's why I called police because they did nothing about it before. Now I have to sue. I got a way better Job now offering me management, but I want justice for putting me through two weeks of hell wondering when was I going to get a job, how was I going to pay my bills, eat, pay rent etc. Luckily and blessed I had good friends who came through and each gave me money to cover all necessities. This is a large Corpoation with over 1200 stores nationwide. I worked almost three years for them. I didn't receive a write-up or anything in writing stating their decision to terminate me. And the funny thing is it's reverse discrimination, I'm causian

Okay, they are all hispanic including management. I was explaining to the manager what a co-worker had said and di to me, while explaining the situation to management the co-worker snapped me in the face with a wet towel!I called police immediately and kept quite continued to work. I have police report. A lawyer has contacted me, I contacted the ACLU also just tonight through sending a fax. I have everything documented. The witnesses are lying, I can prove it, they will be called to testify. this company thinks I will do nothing. I'm hated there because I call everyone under the carpet about things they do even management. They seen this as an opportunity to get even. The managers story conflicts with what he told the officer in the police report. Now do you see how this is reverse discrimiation. I am female. two cooks were fighting physically in parking lot, one got fired the other didn't - he was the brother to a manager at the store. I was treated differently and I didn't even fight

Does 'intentional infliction of emotional distress' sound familiar, as well as a tort for battery? A good litigation lawyer should be able to set you up for a wonderful lawsuit ... I love the way these employers spend their money on foolishness and I often wonder how they stay in business. I might also discuss with your lawyer the possibility of going to the media.

File a complaint for illegal dismissal against your employer so that you could be reinstated in your job and receive the proprotionate damages.

omg....check or the eeoc website...file a compliant..contact your hr,let them know what happened. The eeoc is the first contact you should turn to, One more thing find a good lawyer, we are going through the same thing however we have taken action quickly. eeoc was advised through our first visit and it doesnt' matter how matter how many store they have they are still under U.S. Law..Civil Rights that may have been violated. My advise is not to talk to management at the store level if you feel they aren't taking you serious....Another term you should look up is Slander...wow, a good lawyer could really teach those coworker a lesson....Good Luck, if my thoughts here are a little a disorganized i have been tossing back some Coronas...Good Luck!

get a good civil rights attorney, and also go for wrongful termination against your employer.

That's quite normal. It happens all the time. I caution you against a law suit if you don't have absolute proof of it happening. The police report is just a piece of paper and does NOT stand up against the employees who will act as "witnesses". In the future, you should document such things much more carefully. Get written statements from previous witnesses, etc. WHEN THINGS HAPPEN. There is a lot more to your story and you are not telling it.

No such thing as reverse discrimination.

You didn't give enough cohert detail for anyone to even determine what you are talking about exactly. Someone hit you, ok, when, why, where? What happen before you were hit, what happen afterwards. What did management say to you? What do you say to management? What did the police do? Did you talk to the police directly?

As to those, who want to blame this person for the problem like they might be a fault, just remember this could have easily been you this happen to.

Let this be a lesson, invest in one of those one dollar Subject note books and write and DATE events such as these at work.

Right now you will need to contact an attorney. The first few ones that you contact might tell you that they can do nothing, let those answers go and keep on until you find someone to take the case. Also you will need to get a copy of the police report.

You sound angry and scatterbrained. You can't sound that way if you plan on suing them. You have to clean this story up. Do not make allegations of discrimination in a wrongful termination case. It weakens your argument. You are arguing that you were fired to cover up an assault by someone they wanted to keep. Leave it at that. You have a witness's sworn statement and a police report. They have several sworn statements and the thing you forgot to mention, your cause for termination. That is what is meant by scatterbrained, you forgot a salient fact of the case. It will come down to credibility and right now all I hear out of you is anger. Angry people are not credible. They are vengeful. Now, to sum this all up you already have another job and you don't want this one back, this is not much of a civil suit and a weak criminal charge at best. BTW, why didn't the police arrest your assailant? That is another point you skipped over. It must not have been much of an attack or you did not press charges, but that will count against you. In short, your case is weak and unlikely to get you damages in excess of your court costs and lawyer's fees. You should consider dropping the whole thing and cutting your losses while you still can. Sorry.
