But the fact remains you caused him ABH and he didn't to you. He may have headbutted you but you broke his nose or jaw, that is some whacks to cause such injuries! You would have had to issue two blows at least to cause these. Just because you called the Police does not make you innocent. Also, surely he didn't just come from nowhere abusing you, something led up to this situation getting worse that you are not telling us. I think you are playing the victim card when you are not entirely the victim to be honest, there are some gaps and holes in your story and the obvious thing to do when feeling aggrieved is blame the justice system.

Generally police arrest the primary aggressor; most of the time this is who started the fight. It could have been that witnesses said you started it or that you provoked it... whether you did or not.

Given the situation, a lot of times the law expects you to refrain if you are attacked and then you have the option of running from the threat. It's not a great law, but the law is defined that way in many states. If he hit you first, and there was any pause involved... officers have to look at this as you starting it back up.

In order to actually be acting in self-defense, you have to be in legitimate fear of life or serious injury. A punch, though ridiculous and an assault, does not constitute the use of force if the threat can be avoided.

Talk to the DA, he/she should be able to reduce those charges. Are there witnesses to back up your position?

You would not have got arrested for self defence however. The police must have assumed you committed an offence.

That's where you went wrong, if you hit back then you are responsible for the damage you do with that punch. If you are a boxer then you should know better and have better control of your 'instinct' to hit back than the average person

I agree the justice system is terrible, the same happened to my partner last week BUT he was accused and arrested for racial abuse which he did not do, he is out on bail and waiting trial, there is laws for one and different laws for Asians etc.

Haven't you heard of hit and run if your a boxer and you felt a couple of things break on your fist why wasn't that enough ?instead of phoning the police reasonable force that's why they lifted you

Did you have a lawyer? If you didn't, than maybe you should have had one. Are you considered a professional boxer? If you are, that might be the reason. Maybe you took more action than necessary to defend yourself. What was his age compares to yours? That might have something to do with the outcome.

I agree with you how are we supposed to defend ourselves against unprovoked attacks. I have trained 11 years in Muay Thai and am frightened one day I might lose my license just defending myself so as for being trained in martial arts this would probably result in me being prosecuted just defending myself in this type of situation.x

that is why i always deal in my own justice.i am also an ex army boxer..i dont need the socalled police to get justice because you simply dont get it.their too busy raising money for the government and their own pockets.if i cant deal with certain situations i have a lot of very big mates who can.we stick together.the police are anti public.the army should be doing their job.

My cousin was mugged by three guys, he turned the tables and beat them up so they called the police. Because he was martial arts trained he got 6 months on a first offence

You have absolutely GOT to get a decent criminal lawyer. Ask your friends/family/citizens advice or check the newspapers for the names of lawyers frequently involved in cases such as yours. With your boxing background you could be in serious trouble so get on with it as fast as possible. Do it today!!!!

The system in the uk stinks. My son's friend went over to have a word with someone he had had some grief with in the past, the chap was drunk (police' said so) and he threw a punch at my son's friend, obviously a fight ensued, my son who was waiting at the bus stop for his friend seen that the fight was getting out of hand and went over to stop it, punches were flying but my son managed to drag the chap off his friend. The chap escaped with minor cuts and bruises, the fracas was over in two minutes. The chap rang the police and my son and his friend are accused of ABH. group attack. How disgusting. He does have a lawyer and a barrister.
