I have a huge problem?!?!?!?

I'm 22, my parents are divored. I live with my father... I work full time and I'm in school full time!!
For the past 2 years my mother has been claiming me on her taxes illegally through jackson hewitt (obviously she knows my ss#) So, I haven't gotten any tax money since 2006.

But my question is does anyone know how I can stop her without a lawyer?? I can't afford a lawyer. I'm also scared she'll be able to ruin my credit... (yes she's crazy, I already know that)

I do file my own taxes but I don't get all my papers until closer to april... so when I file I get a paper back from the IRS that says I've already been claimed

Contact the IRS and the PD for identity theft. It's free.

Did you file tax returns over the past two years? The IRS may allow you to refile after the investigation of your mom's returns.

Contact the IRS. I have found them really helpful with tax questions when I have called them in the past (past 2 years).

I bet if you claim yourself on your taxes and she claims you as a dependent, your claim will supersede hers and she will end up owing money.

If she won't be reasonable about it and stop because you ask her, the best bet is to file you're own tax return. It should cause her claim of you as dependent to get rejected and she'll probably get audited.

But, since yoru story seems to indicate that hasn't happened, you should still file, and then contact the IRS as if you didn't know what the problem was when it comes back with no money for you. This should spark them into looking into what she's pulling.

File your taxes as you should and inform her she is not to use your SSN you can't get in trouble.

Just report her to the IRS. Also put a fraud alert on your social security number with the credit reporting agencies like equifax, experian and transunion. They will screen your number for like 3 months, then you can do it again. This way, if she tries to open any credit with your name and number it will stop and go to you first for approval. I had to do it once cuz someone got my number. They never tried anything though. Every time I went to get credit myself in that 3 month period, the credit reporting agency called me on my cell phone to check with me first.

Your only recourse is to contact the IRS and tell them what is going on and see what they tell you to do.

You can do it by filing your own return. Once you file your return, they will look at what is going on and then they will discover your mother is doing this illegally. That way you don't have to get into it with your mother.:-)
You can also call the IRS and act really innocent and ask them why you aren't getting any tax refund? They will look into it and they will discover what's going on.
Let the government work for you! No attorneys, no fights and you'll get your refunds:-)

Did you even file? File your own tax returns and let the IRS sort it out. If you tried filing and they sent you a letter about your SSN already being claimed, you should have responded to the letter and notified them of the situation. If you haven't filed, do it now, even if it is as far back as 2006.

If she has been claiming you illegally, then you have to choose if you are going to report her, which leaves her open to possible prosecution. Obviously, if you lost a bunch of money by this, it is a form of theft to you. You will have to prove that she did it intentionally, and that she had no grounds to do it.. that might be easy, if she lives far away and your work records proves you were not able to be living with her.
The alternative is to notify her, in no uncertain terms, that she is to STOP this in the future, so that your return next year will be correct. And follow through. it means giving up what you have lost so far, but avoids having to report her for fraud.
It is an option only, either way. I don't think you need a lawyer to report her, since if there is fraud, IRS will investigate for itself.
You are the only one knowing her well enough to know if she is putting you in risk of other id theft, such as using the number for other fraud (credit cards, so forth). YES, she can ruin your credit. You might be able to let go of the prior tax returns.. but only you can decide if you should.

Yes you can - for one thing, many offer a free consultation.

For another you need about an hour or two of his or her time to write a stern letter demanding she straighten all this out, including reimburse you for the refunds you did not get but were entitled to. A mention that the IRS will hear about it in 10 days will probably get her attention.

the attorney might also have something to say to jackson Hewitt, which has deep enough pockets to reimburse you while they investigate their sloppy, possibly unethical and illegal work practices.

Finally, the attorney can help you file amended forms, or object properly, with the IRS.

Depending on how much that you are owed, you might find an attorney that will work for a percentage of what they can collect and not bill you until then at all.

The attorney will be able to reassure you on that.

In any case, be sure to file your taxes *before* your Mom does in the future.

claim yourself as head of household on your taxes and call the IRS- tell them what's going on and they will investigate it. if your mom tries to ruin your credit press charges against her for identity fraud
