There has to be more to this than you are telling us.
A wheel wrench should be carried in a car so be done for having an offensive weapon when you have one is rather strange.

i find it hard to believe that just on the strength of you having this in your car the police have charged you.
there must be more to this story had you just had a road rage row with some-one, had you just been to an ex g/f house trying to get in.
if im wrong im sorry but every car on the road should have a wheel wrench in it somewhere just coz its not in the boot cant be enough to get you nicked |

I know you can be arrested in England for having a baseball bat in your car (as it's an 'offensive weapon!) UNLESS you can prove you're using it to play sports with i.e. you have a baseball in the car! My friend got pulled over for speeding once, and his bat (which was his 10year old son's!) was on the back seat and the cop arrested him for possession of the weapon! His case was completely thrown out- I think the law picks and chooses when the enforce certain rules, but they always seem to do so at the wrong times! |

A wheel wrench probably a lug wrench is not a weapon it is a tool unless you use it to attack another person or threaten to harm them if none of these things happened a lawyer can get it dismissed but to give an answer on possible outcome is impossible because you did not say what country or state you are in.~ |

Oh man, does your family know a lawyer ?
First off, why were you ticketed ? Were you pulled over or were you in an altercation before hand ? If you were pulled over for a traffic violation and ticketed for having an automotive tool in your car, then all you should do is tell the judge, that you put it there because the last time you fixed your car, you left it out after closing the trunk and forgot about it. The only tool that shouldn't be around is the cop who ticketed you. |

You're in England and some English law is strange to say the least. However, you can tell the judge that you were under the impression that you could store your personal property and equipment any place you chose as long as it did not interfere with operation of the vehicle and as far as offensive weapons were concerned, you had one attached to each of your wrists. So, what were you you supposed to do about them? |

It's pouring rain outside, but I went out anyway and got all the wrenches and screw drivers out of my car, man I had no idea I could go to jail for having those kinds of tools in my car. I can have a billy club in my semi truck as long as it doesnt have a string through it. You gotta love the law don't you. |

it would be a very intuitive police officer to locate this item inside your car door whilst closed, therefore, I can only assume the door was at some point opened. were you cautioned and arrested? cautioned and questioned pending report? informed of your legal rights, if not arrested? was the offending item seized? did you state that the item was placed there for self defence? were you in an area where another crime was committed? if not, seems a bit harsh to take you to court, whereas a caution may suffice. either way, still kinda stupid |

You must not live in the south. It all depends on the judge. Anyone with common sense would assume the judge would dismiss the charge, but you can never tell. Either way, they still made court cost off of you. |

If this goes to court its a "big deal" these Judges are sick and tired of these "offensive" weapons being carried about by the public, and that policeman is going to make out your "car wrench" was the most
"offensive" weapon he has ever seen. and if you are "known" to them
they will "nail you" , In court the police are not going to have the judge
tell them their wasting the courts time, so they will make a strong case in there against you..........or it won`t go to court.
If your telling us the truth about this incident, then you are up against
a "smart ar*sed" policeman who wants to score some "points" for
himself......if thats the case you haven`t got a lot going for you.
Remeber in court its not about right or wrong, its who has the best story to tell.................................sad but its true.

First, you said " boot "so you are English or maybe Canadian. You both have strange laws regarding normal ( to the rest of the world ) tools.
Next you just registered today. Everybody must have an initiation date but that raises a flag. I will accept that this is genuine though.
You have a tool that is normally included with the ownership of a vehicle. I doubt a judge ( or judges, depending on Judicial system )
would consider this an offense.
Maybe us Yanks are not so stupid. We at least consider intent of action as well as consequence. |
