What country? If the United States, then committing a crime, even on your own time, is reason for dismissal. Most contracts specify that the company reserves the right to cancel the contract if you have committed a crime.
You failed a drug test. You admitted to use. Doesn't matter where you did it. You're likely in violation of your contract. |

If you test positive for weed - you can be fired. That is the agreement. It is a risk you take when you do something illegal. There isn't anything you can do about this - except stop smoking. |

Even though you were smoking it on your own time, the drug will take a while to get out of your system. Therefore you tested positive. They had reason enough to fire you because 1 it is still illegal and 2 it will effect your work, particularly if you are a driver. |

If there is weed in your system during work hours you can be sacked. Also, this is highly significant if you are using a van during your work day. Don't smoke drugs and drive! |

i personally have nothing against smoking on your own time. however, it IS illegal and your company has a right to fire you if you test positive on a drug test. that's the risk you take when you do something illegal, however unjustified it may be. |

You tested positive for weed and were smoking illegally in your van. Just smoking weed is enough to get you sacked. It is always illegal and if you are daft enough to turn up for a medical after you have smoked it you deserve everything you get. you are driving under the influence of drugs |

It probably doesn't say in your contract that you're not allowed to commit burglaries or murder people in your own time! This is a criminal offence and there is ample proof that you have been indulging in it. Cannabis has an effect on the mind, the coordination and the general ability of a driver to drive safely and the level of cannabis in your blood must have confirmed that you are an habitual smoker, as indeed you say yourself. Your employer was probably obliged under the terms of his insurance to get rid of you. |

You would still be over the drink driving limit.

if your job involved a certain degree of driving they can sack you if they have found an intoxicating substance in your bloodstream during working hours.
if this is in your employment agreement-you are f*cked-if not sue them!. |

They can sack you for smoking weed in your own time, in fact my employer sacked someone when he admitted to smoking weed several years earlier |

if they catch u smokin at work or in possession then they can definitely sack you, if it's just an allegation, it maybe different. Some one can make something up and get u sacked, that doesn't sound right. Depends where u live, u can try for unfair dismissal or seek professional advice form a body like citizens advice |
