I havent gotten payed since before christmas! is this legal?

Well, i have been working in an office for about 8 months already, few times before i have had trouble not getting my paycheck on time, howver now its just anoying. they have not payed me for 92 hours of work, since before christmans and i really need the money i e-mail them a few times and they said oohh is the payroll department that is getting things confused (since i am a temp) but i think it is not fair! i dont know if this is ilegal in florida? but i am anoyed i even had to borrow money from my father to pay my car! help!

I would contact your state Equal Employment Opportunity Agency. What they are doing is clearly against the law. If they agreed to pay you weekly, then they should be paying you.

Definitely something is messed up. I don't know how it works in florida but isn't there a labor board or something similar that you could go to and make a claim? It can't be legal.

Labor law in Texas says you can invoice them and they have a certain amount of time after the receipt of your claim, but the must respond or they are in trouble. Talk to the labor board in your area, and tell your employer you are doing so. How do they expect people to live without pay when WORK is how we live?

This is illegal anywhere in the U.S. - this can easily be rectified by calling your local IRS agency. The IRS takes these things very seriously and will even lock the place down if you don't receive your paycheck. Of course, this is the extreme, but I would certainly call them.

I am pretty sure that that is illegal. You are supposed to have check in hand on the scheduled pay date. If I were you, I would go sit in payroll's office untill they do something for you. Talk to your boss as well, so that they know what is going on.

definatly not legal...tell them if you din't get paid you are calling a lawyer and that you want the payroll offices number and contact name.

The law may be different here in the UK, but in general it depends on the terms and conditions you signed, it may be illegal but what can you do about it without upsetting your employer and i think they know that too, just make sure you keep a record of the times you worked and the pay you have received from them and outstanding pay

It sounds like they are a very disorganized company!!!! It's probably not "illegal" per se', but I'm sure there's various things a good attorney could drum up to sue for. However, it's really not worth the effort.

I will assume that you have all your payroll records and copies of the e-mail exchanges you've had.

It's now time to raise it up a level. You need to take it higher in the management chain or you need to discuss it with the temp company you work for.

this should never be leagal ! I never heard that before that somebody had trouble geting payed. If you work for a temp agency tell them about it ! Let them know that they have one week from now before you seek leagal action . just telling themn that should help get your money . Did you talk to your dad about it?

It is not legal anywhere.Since you have already emailed them, did you keep a copy of the email.?? Write them a letter and tell them that if you are not paid [give them a certain amount of time in which to pay you] you will be notifying the State Attorneys office and file a charge with them for non-payment of funds owed to you since before Christmas. Keep a copy for your files
Meantime contact a lawyer and get him to do the same. You say this cost money true but if you want something done right then it is worth it. Then I would start looking for a better job and make sure they are reliable...

I am a staff supervisor for a temp service in florida and we have never had this problem. I would recommend calling the corparate office of what ever company you work for and demand a resoultion , if that does not work call a lawyer that deals with wages

i assume the temp service is the ones who are not paying, not the place u physically work. in all likelyhood they are still paying the temp service for your services. lets say you make 8 bucks and hour. the temp service charges 10 and pays you the 8. thats how they make money. use this to your advantage. here is how....

give the temp service one last chance. tell them you need a check today. if they give you the run around tell the job you are at what is up with the temp service not paying u, and if you are charming and ask nicely and they like you they could tell the temp service they will not pay them for thier service until you are paid in full. again, be reasonable, but tell them to cut you a check today, on seperate checks so that the taxes do not kill you. dont be a b**** about it be direct. it is your leagally earned wages.

with the temp service now in danger of not getting thier rightfully earned monies i bet you get your money at light speed. again it depends on how good u r with the current job, and if they like you. plead you case to your boss and/or human resources.

if not contact the national labor relations board. if you have gotten late fees or charges due to this a lawsuit will be in order.

legally, the pay structure is in your contract. they have to follow it just like you do. just like if u r late, they can fire you. fair is fair but the man dont always play fair so use the advise i give. remember fair is fair.

They should be paying you in a timely fashion. Most companies only issue checks on a few set dates in a month... it might be every Friday or it could be on the 15 and 30 of each month. Because of this many payroll departments just wait for the next check writing day to correct problems. This, in my view, is mostly out of laziness.

Contact your supervisor or his supervisor if you are getting nowhere. Someone should be able to make a call and get you a check within a few hours. Ask them how they would be doing financially if they had not been paid for almost a month.

Given how long it has been since you were paid you may or may not have a legal claim but realistically it isn't actionable. There are some federal regulations regarding pay and overtime. They should be posted someplace like a break room. Ask payroll to send you the company's policy in writing if you really want to go down that path.
