I just found on the State computer that someone filed a civil complaint against me that is slanderous can I?

There was never any action taken on it. I found it by complete accident looking someone else up, due to my name was spelled incorrect on this complaint.
This was filed falsely against me in 2005. Is there anything in the law regarding exception for Statue of limitations for me to file a slander suit, due to the misspelling of my name, and I was never served with any papers either?
I intend to go down to the state's office and read in full. I found it on my home computer.

It would depend on your state, but it would be typically 1 yr. Thing is, you have no slander damages to sue over since, 1, you were never actually sued, 2, your name is misspelled and no action was ever taken against you and (definition of 'slander) states that harm must come to you and your reputation and/or standing in the community. Non of that has/had occured. You found it by accident.
No damages...no standing for a suit. |
