This answer is specific to California; your state laws may be different:
Were you charged with 23153(a,b)? That's a misdemeanor with a hefty fine of $1,955.
The only change to the law I found for 2009 relates to people who are on probation and get a DUI.
Edit: Just to be clear:
23153(a,b) is titled Driving Under Influence of Alcohol or Drugs Causing Injury, and indeed different from and costs more than 23152(a-c), which is titled Driving Under Influence of Alcohol or Drugs. |

Don't listen to anyone on this board...Instead, contact a criminal defense attorney that specializes in DUI defense. The laws vary from county to county, so no one on here will have any idea of your situation is a felony.
Call up an attorney in the phone book and they will get the police report to see what the cop charged you with. If they did charge you with a felony, you could probably plea bargain down to a misdemeanor. (In our criminal justice system, the vast majority of charges are plea bargained down to save tax payers the expense of going to trial.)
However, we really have no idea if you were charged with a felony or not....it complete depends on what county you are in and what the prosecutor feels like charging you with. I had a friend crash into someone and he only was charged with a misdemeanor....

i think it's ABSURD that it would be increased to a felony because YOU got injured, but with MADD hysteria, it's certainly possible
