I live in Arizona can a credit card company sue me in New Mexico?

I have been served to appear in court in New Mexico they sent the papers to my grandparents house. I haven't lived in that state for a couple of years I'm a resident of Arizona I thought I had to be sued where I live? If you need anymore information just ask. thank you

Maybe, maybe not. Whether a particular state can establish jurisdiciton is a topic that covers about 15% of a typical civil procedure textbook. In other words, there is no "yes/no" answer to your question if the only fact you provide is that you live in Arizona.

If you breached your credit card contract in New Mexico (i.e. you lived in New Mexico when you decided not to make payments), then you can *probably* be sued in New Mexico.

If your contract with the credit card company states that all cases shall be in New Mexico court, then you can *probably* be sued in New Mexico.

Bottom line: If you'd rather not go to New Mexico to defend yourself, then talk to a local lawyer about your possible options.

If you read the credit card agreement, it's governed by the laws of the state where the company is located, namely whatever state's laws are most favorable to them.
