I live in a condominium we owe it, it is not rented. They changed the rules to we can only have 1 dog?

Most condominium communities have bylaws, with which all residents must comply. You should have received a copy of the bylaws, rules, and regulations when you bought your house. The procedure for making changes to the bylaws/rules/regulations should be included.

Generally, to make such changes, a certain number of owners (51%, 2/3, 3/4, etc.) must approve such changes. If they made the change in compliance with the approved policy to do so, then there is little you can do about it.

If the rule change was appropriately approved, and you only have one dog at present, then you cannot get a second dog. If you do, you will be in violation of the community rules, and will have to face whatever penalty is prescribed (usually monetary).

You need to read your contract with the condo association. It should spell out what they can and can not do. You do rent access to the shared portion of the property.

Generally fine you 50-1000 bucks a day till you get rid of it.

Your HOA agreement says you will abide by the bylaws and the changes as they occur. You don't have to agree to every change in writing

It depends if the rules are simply rules adopted by the Board of the Association or if they changed the underlying documents often called the Covenants, or CC&R's Codes Covenants and Restrictions.

If the board adopted a rule you have to see first if the CC&R gave them the authority to regulate this ... it may it may not.Usually boards have the authority to adopt rules for governance of common areas and to allow it engage in enforcement of things already in the CC&Rs. But Boards often don't know the limits to their powers and try to regulate well beyond their authority. So read all the documents carefully and understand what their authority is for this. If you don't think they have authority pay for a consultation with an attorney to get an official opinion and maybe write a letter to the board to challenge the rule.

If they have the right to adopt such a rule you can argue that since some dogs are grandfathered there is really neither a good reason to limit the number of dogs or there is an unequal application of the rule.

Sorry to say though most of the time owners will not win this kind of dispute. Don't get a dog until you get the rule changed waived, etc.

An HOA can sue you and depending on what they are suing for, take your condo away from you. Never, ever get a house or condo, you give up your freedom.

Read the rules of the homeowners' association, or whatever it's called.

THAT'S what you signed when you bought the place.

And you should have read it BEFORE YOU SIGNED IT.
