Florida:
I met and married an immigrant. When we met he had actually overstayed on a visitor's visa and was therefore illegal. We married in April and after we married, I petitioned for him to stay in the country. He received his work permit in August, and then I basically did not see him for an entire month. In September he completely blew off my birthday (didn't bother to come to the dinner my friends arranged for me - and in fact left town that afternoo) and we had a terrible fight. About a week after the fight, we received notice from the USCIS that we were scheduled for the immigration interview in November. His tune changed and he was suddenly sweet and kept it up from all through October and into November - worried that I would say that he was being an a-hole. The interview went well BUT because his FBI name-check was still pending he was unable to get his conditional residency.
So - things were going well after that until he decided that he needed to be out of town for Thanksgiving, Christmas and New Years at his part-time job. A part-time job in another city 2 1/2 hrs away at a place that he will not tell me the name of.
He also admited (when we were discussing possibly reasons why the FBI check was taking so long) that in the country he's from, each person, when they get to a certain age has to serve in the military for a year or three --- he admitted that he told the officials in his country that he was gay in order to avoid serving.
I've contacted the USCIS and basically they said that I just needed to send them a notarized letter, withdrawing my petition - which will in fact remove his protected status now, which will possibly end in deportation. Should I just do that and file for divorce once he's removed from the country. Or should I rescding my petition and file for the divorce at the same time. Florida is no fault and I have no money to go through a court case, what can I say to him to get him to agree to sign and uncontested divorce. We have no joint expenses. The house was mine before we were married and we have a prenuptual agreement.
I need to be rid of this sociopath before I pay with my sanity. Can I get an annulment if I assert that his bahavior is a testament to his intent and that his vows amounted to fraud? What's my best course of action?

I'm sorry to hear your bad news, I feel ashamed to admit it but, I was once like your husband, although, I want to tell you , I didn't use anyone for US citizenship.
I met a Seattle woman when I was with the British Army & fell in love with her straight away, thing is, once I quit my life in Britain & lived with her, I started to realise I'd made a mistake....I ended it myself, but part of me was wondering, if I played along? You know what I'm saying?
I hope you will look after yourself, we have this saying in England, .... if you feel that something is wrong in your relationship with another person, You are not wrong. otherwise, why would you feel it ?.
My advice, look after yourself & write the letter to the INS & begin divorce proceedings concurrently, or in his absence get your marriage annulled using evidence from INS
