I need legal help regarding ebay, pleasssse?!?

I was bidding on an item that i did not win, then i received an email saying i had a second chance offer. The item, a mobile phone, was originally going for around £150 and the offer was for £20 so i instantly jumped at the chance. I bought the item straight away and sent the money via pay pal. This all happened within around 5 minutes of the offer being sent out.
Around 10 minutes later i received an email saying that the seller was new to ebay, did not understand the concept of a second chance offer and could not possibly sell the phone for £20. What i want to know is is the seller obliged to send me the phone now. He has made the offer, and i have accepted and sent the money. He has offered me a refund but i don't want a refund i was the phone i have purchased. Can anyone shed any light on this? Should i take this to pay pal?

Its a binding contact. They have no leg to stand on. Tell them that you want the phone and if they don't they are in breach of contract and subject to legal action. File a claim with ebay if they don't send the item. It would be a long road if you want to take actual legal action but it could be done (not worth it in the long run I think). |

The new seller just make a mistake, be reasonable. I doubt ebay/paypal will take your side. |

No, you can't do anything about this. It was an honest mistake. That being said, it's $20 and there is no attorney in the world that will take a case for $20 |
