I am 16 years old and live in CA. I am graduating HS this year with great grades. I have a steady job and bring home 1300-1600 a month. I pay for my own car, cell phone, clothes, food, etc. I live with my father and his gf, my parents had a nasty divorce when I was younger. I would like to move out, I feel like i support myself in every other way, and I'm not happy at home. I know that most people have serious reasons(abuse, neglect) and I don't know if I have good enough reason to move out. I will have to take my dad to court and I don't want to do that if my chances aren't good. Basically I want to know what my chances of being awarded emancipation are.

The reason I want to move out is because of my parents divorce. They got divorced when I was 11, and ever since then it has been crazy. My parents stopped taking care of me. I didnt start going to HS online because I wanted to. I dont want to work over 40 hours a week. I have to. Last year I had to go to court and speak in front of half my family. My mom was drinking bad and thats why i left her house to move with my dad. I had to go in and talk about her alcohol problems, as well as my brother and sisters drug problems. It was very hard on me emotionally and I cant deal with that. My dad just got a new gf and I know my mom will start taking him to court again. I cannot go and talk the way i did before. i love my dad, i dont hate his rules, i am a very mature girl and its nothing like that. I already support myself in every way except rent and i am fully able to pay my own rent. im just sick of being emotionally put in the middle of this divorce which they are still going in court for

Your chances are pretty slim. You're not in a bad home. You're not being abused.
Instead of being so eager to move out, why don't you save your money for a house? Maybe you & 2-3 or 4 friends can rent one & split the bills.
College is around the corner & you may not be able to keep your job & go to classes full time. |

You can file for emancipation, but here are the top three things you have to prove to a judge in order to stand a chance of it being granted.
1) You can support yourself. This does not mean living with a friend, living with other relatives. This means paying the rent, utilities, groceries, etc on your own.
2) You have a good reason. Hating your parents, hating their rules, because I don't want to live there anymore do not qualify you for emancipation.
3) Your parents have to agree to it. |
