I am looking to start the fund raising for my company, and am wondering if it is illegal to solicit in front of a store without the store managers permission.

Passing out fliers on a public sidewalk, in front of stores, in a downtown setting is probably ok. In this situation, the public right-of-way usually extends up to the storefronts or close to them. Store owners might not like it but can't stop you.
If, on the other hand, you intend on soliciting in front of stores in a commercial development (i.e. walmart/target type facility), you would need to obtain permission as this is private property. Your invitation to use this property extends only for visiting/shopping at these stores. You do not have public access rights in this situation. |
