more because they didn't post my check until april, when there was an increase in sales tax in California. am i still responsible for that? i specifically asked them when my payment needs to be received by, and i paid the amount they gave me to include all fees. it's not my fault it took them days to post my payment. can i just refuse to pay it?

i mailed the check overnight to their overnight address on friday, mar. 27. they are a 24/7 bank they claim...but either way, they were in receipt of it before the 29th like they told me.

It's iffy.. Assuming the check was received by 3/29 (which was a Sunday, BTW), they should not take too long to post it, but there are very few laws regarding how business do that, which will make it hard for you to refuse legally.
If you have any way of confirming the check was received by the processor prior to or on 3/29, then I would ask to speak to a manager there and request an adjusted bill. |

I would get a copy of your cancelled check and find out when they deposited it. You might be on a fine line here. 3/29 was a Sunday, so there is no mail delivered then. You might need to have had it to them by the preceeding Thursday (3/26) in order to have it post in time.
Also, check with the sales tax office in California. In most states, the taxes are calculated at the time of sale, not at the time of payment. I'm not sure about CA though. |

OK you aren't saying when they got the payment. Perhaps I should say you aren't saying when you sent it. Give the mail a day or two. So if you sent it Saturday, the 28th, then you wouldn't have given them like any time to post the check. On the other hand they KNEW the tax was going up so how far in April did they post it? If it was like the 2nd or 3rd I may be suspicious of why. Without knowing when you sent the payment and when they got it there is very little to argue about. I don't see how you can refuse the payment unless you can show they intentionally didn't post the check until the tax went up. If you sent the payment with a week to the deadline or so then you may want to talk to a lawyer with a free consultation. |
