I received a "Writ of Summons"?

I have failed and neglected to pay off my stupid student loans and have ultimately received a Writ of Summons. The problem is that I have no idea what this means! What happens next? What do I do? If I neglect to request a trial, what will happen? Does anyone have information on this at all?? Desperate for help, guys.

If you owe money for a student loan they just want to know when are you going to pay it and usually want some type of payment that can be arranged through the courts and then if you file taxes they will take that to cover the cost of the loan. Unit the debt is pay there will be a judgment on your credit report. So try to settle it, Let just say you will make payment of $150.00 a month, they have no choice but accept it. So don't worry too much it just only money they want to pay off the loan.

A Writ of Summons (W/S) is simply a notification that the Student Loan folks (SL) have filed a dispute against you in a court of law. Most likely they want their money, and you have neglected their previous requests for payment.

On the W/S it should tell you what you must do next. You usually have three options:

1. provide a legal document called an Answer, in which you simply say that you will dispute their claim and let a judge decide (you can get a copy of the Answer form at your court house or have a lawyer do one up for you); or

2. ignore the whole mess and they will get a "default judgment" against you allowing them to garnish your wages and any other means the judge thinks appropriate; or

3. call the SL lawyer and set up a payment plan that both sides will be happy with. By doing the latter, you will "offer to settle", thereby avoiding any further court appearances (by far the best course).

However, since you have forced them to go to these lengths to collect their money, you may be liable for their legal costs up to this point. Nonetheless, it's certainly better than having to pay ALL legal costs if the matter goes any further.

Whatever you do, don't panic. You have a right to dispute this if you feel their figures are not correct, or for any other reason, and the W/S gives you the opportunity to do just that. If you don't dispute the amount of their claim (the amount you owe them), then just go with #3.
