In my town,they made it a law that anyone under 18 smoking in public can be fined. The cops monitor the school area and do give out fines to those that they catch.This came about because the kids were smoking on the corner right off the school property and the home owners in that area were complaining about the amount of litter that the kids left.I can't say that I blame them,there were sometimes 30 or more kids hanging out on these people's property.I wouldn't like it either.
Guess it depends where you live,it is probably left up to each town to monitor this the way they chose.We also have stings on the stores.The cops will hire an underage person to go into the stores and try to buy cigarettes,if they are allowed to buy them without ID,the store and the cashier are fined.I guess my town takes underage smoking seriously. |

Unfortunately, it's not illegal for kids under 18 to smoke. However, it is illegal for stores to sell to them and also for people to buy cigarettes for the kids. I agree, I wish that schools were stricter and had harsher punishments for kids caught smoking. |

Because nobody really cares. You can't stop a kid from smoking. No matter how hard you try he can still get them from parents, or friends. You never really know. All you can do is pray. |

yeah... but its parental responsibility... I know that at gas stations there are signs that say buying them for minors is against the law... so it might just be purchasing them |

our high school had a designated area for smoking, off the grounds, at a park a couple of blocks away. It is not illegal for kids to be smoking, just illegal for kids to purchase cigarrettes. It is also illegal to buy cigarrettes for kids, so, youre right, they shouldn't have them in the first place. but, unfortunately, it is not illegal for a kid to smoke a cigarrette. At least, not in our state.

I've noticed it too, one of the problems is that the school can't really enforce the laws, only the cops. The pricncipal can write them up but can't give them fines and put it on their permenant legal record.
The other problem is that some kids in high school are 18. They still can't smoke on school property but if they are on the street it is legal. The cops can't card someone just because they look too young, they have to have another reason to confront them and demand ID. Just like the cops can't pull someone over if they look like they are too young to drive, but if they pull them over for something else and find out they are too young, they can then enforce the laws about driving age.
Its a stupid system. but in reality, if you stoped kids from smoking outside the school they would probably still do it, they would just do it somewhere else. |

I don't know where you are from, but where I live it is illegal for kids under 18 to smoke and the schools here do enforce it. There will always be some kids who will smoke, drink and do drugs all of which are illegal. You need to talk to the administration of your school. Maybe my schools are just "more stricter" than yours. |

i think its illegal to buy cigarettes if you are under 18, but u can still smoke them at any age (even though kids shouldnt smoke, its bad) |

I agree with you, young lady, kids should not be smoking. However do you think that we should let government to control us even more than we do presently? They already tell us that kids can't buy smokes, they have arrested people for selling them, for selling booze, for DUI, for underage drinking, and so on. I could go on forever, but what good would it do?
If you could find a way to enforce these laws,more power to you. Maybe you could become an honest politician. Pardon the oxymoron.. |

its only illegal to buy them. as long as kids under 18 dont buy cigarettes the can smoke them all they want. if a cop sees a kid smoking a cigarette they really cant stop them. only if they buy them can they get in trouble. i personally think its stupid. . if you cant can buy them you shouldnt be able to use them |

how did they get the ciggerates in the first place? its illegal for them to buy them. and yes i think they sould be stricter. i am 15 and dont smoke, dont want to smoke. but they should not be allowed on school property. |

I dont know where you live but where I live, I would NEVER see the kids smoking outside the school.
I'm not saying they dont smoke (some of them) but outside the school??? Im dumbfounded.
When you were underage, did you ever drink alcohol? How did you get it? End of comment |

If they are infront of school they can argue the fact that they aren't on school property, therefore, they (the school) can't control what goes on.
The same thing happened at my high school and that's what the teacher's told us. If you aren't on school property, you can pretty much do what you want. Who knows...smoking is gross! |

Smoking for individuals 18 and younger is illegal in every state. In many states they charge them (ticket) with underage smoking. In others they simply try to enforce the laws prohibiting sales of tobacco products to minors. It is a matter of resources and enforcement strategy. In most schools you can also be suspended if you are caught with cigarettes. |

Well now a days, you have kids that look like they are 17 even 21. so they can just go to a store and buy cigarettes. And then again, some stores don't care or even check for ID, they just want the money. |

It's just a matter of time. I'm 30 now, but when I was 17 (six months before I turned 18) I got a ticket for underage smoking in the front of my high school. The fine was $500. I had to actually go to an all day smoking diversion class as well as volunteer 20 hours to get the charge dropped. That was in Lincoln, Nebraska. I don't know about how strict they are elsewhere. |
