Do you have any proof? For example, did you take a photo, or keep the staple or uneaten portion of the pizza?
Even if you don't, I would inform the restaurant manager as soon as possible, and if his response isn't satisfactory, then you have every right to pursue it in court.

You can try but that one would be hard to prove and if nothing happened to you, even harder. Staples are not used near food processing so it is unlikely that one got into the pizza or the toppings. |

i found a piece of the foam or w/e they make those take out boxes out of in my salad and i almost choked on it. they gave me the salad free and we could all have a desert for free. they were really nice about it tho. and they apologized and stuff. =] |

You can sue them for the cost of the pizza, plus your medical costs as a result of biting on the staple.
If you weren't injured, just tell them about it, and they'll probably refund you the cost of the pizza without having to go to trial. |

Was anyone injured from the staple? If no, then forget getting any $$$ award by the court. YOu can't sue over what COULD have happened. |

Did you get hurt? Did your kid? Did they need medical attention? If they did, yes you can sue for medical expenses.
If no one got hurt, just bring it to their attention and they'll make it right with a free meal or something.

Depends on how certain you are that it was served to you like that. If you brought it home or had it delivered it will be be harder to prove that it was their fault. Also, if you don't have the money for a good lawyer, it could make your life worse not better to sue them.
If it were me, as long as my child didn't get sick or hurt, I would just never go there again. There's no point in sueing otherwise. Maybe report it to the BBB if anything. But that's me. |

yes you should take it up with the manager, but if you want the big buck take it to court for neglegence which is a tort and you will receive money for damages, punitive damages and all sorts |

you should. the staple could have punctured his/her stomach and that is a case. what pizza company was it. if you cooked it then definitely dont, that would be stupid. but assuming i just looke at the question and it says resturant that you didnt make it. lol. but yea, you really should. you could probs get some money or something from it. there is no way that they cant be found innocent or not pressed charges. thats a danger to consumers. |
