First of all get a survey make sure what is your property and what is his and then see if his fence is on your property then you tell him to remove it or you will have to call the city and they will make him remove it. |

depending on how far it is over the line...you could either ask them to purchase the amount of property they are over or move the fence...its your property and entitled to one of these choices |

How long as the fence been there? If you just bought your property there would have been a notice advising you that there was an encroachment. You can ask them to move the fence if it's pretty recent. |

contact the county and see if they have a survey on file... if not you can get a survey done. If it shows he is on your property, then you can send him a registered letter asking him to relocate the fencing... If he refuses, you can sue. I wouldn't take it down yourself unless you want to get into a fist fight over it. |

then express your concern (whatever it is, I don't know what concerns you about it specifically) to your neighbor and see how he feels about it
there are several options that might work out
for instance, you could sell him a little land
I think it would be the very last resort to get a lawyer and make sure you are following all the correct procedures and then send him a registered letter telling him that you plan to demolish the fence on your property starting on a certain date |

You have to have the property surveyed, first. If the fence is on your property, ask the owner to remove it. It may depend on how long the fence has been there.
Most states have a "statute of repose" that applies to improvements to real property. In PA it is 12 years.
If the fence was put up recently, and it is on your property, the fence installer or the surveyor may be liable.
Ask yourself if it is worth the hassle. If only a small amount of land is involved, you could end up creating an enemy. |

well first you need to tell them. If they don't believe you or do nothing then contact your neighborhoods association committee. If you don't have one then either call the police and see if you can place a complaint or get a lawyer and sue. |

im a land surveyor..b4 u can do anything u have to have the property surveyd...how do u know its on ure property? how far do u think the fence is encroaching on ure property? u know fences arent cheap if its a half a foot or so...or something that doesnt really bother u...dont worry about it and keep the fence... |

I am building an extension and their fence post and the concrete base is on my property where the footing will be dug. I have ask them to move it nicely but they are refusing saying it has been there for 44 years meaning it would be the oldest fence in the world!! A surveyor has told me its on my property so what's the best way of getting it moved? Any answers appreciated. Thanks. |
