You are two faced cry baby when you want legal rights when it is for your you but scoff at the law when it is against someone else you are stealing from to probably buy your smack.
Can't take the punishment then don't do the crime!
You'll find no sympathy here mate.

If you were shoplifting, they have a right to use force to detain you until the police get there...in most cases they can even handcuff you if needed, so i doubt you have a case if you were caught. |

A Security Officer working for a store has exactly the same rights as a civilian in the street.
If he/she is instructed by the employer to apprehend anyone stealing from the store, as much force as is reasonably necessary can be used to detain.
You don't say whether you had been detained for stealing from the store but I have to suppose you were so, if you were struggling to get away, the 'force' necessary might be deemed adequate by the Court.
If the Security Staff have reason to believe a criminal offence has been committed, they have the right to detain.
You say you have already made a complaint to the Police so they will interview the person who identified you and or the Security Officer before any further action can be taken.
Leave it at that for now. |

No they are not allowed to touch you, well i guess they are but they are opening themselves up for all sorts of legal trouble.
Even if they just touched you on the shoulder that could be construed as assault. If he/she tried to strangle you then that is definately assault.

What the store rent-a-cop did is a felony. Call the local PD or DA and swear out a complaint. You can also bring a civil suit against the store cop and the store itself. Contact a lawyer. |
