I was charged with possession of marijuana?

a friend of mine needed me to pick him up IN HIS CAR because he was too drunk to drive. I got pulled over for speeding and the cop made me get out and asked the owner of the car (the passenger) if he could search the car. He found some "marijuana" under the drivers seat, i have no idea how much or if they even found any, because its not my car. they found a pipe on the owner of the car and gave it back to him and gave me a ticket for possession of marijuna because i was driving his car. I understand that i am liable for the contents of the car because i was driving, but i was driving because the owner of the car was too drunk to drive...so basically i was the designated driver and i got a ticket for possession of marijuana even though it wasnt my car. Do i have a case, or am i screwed?

If you can get your friend to come to court and say "yeah it was mine... she had no knowledge it was in the car" Then i cant imagine any sane judge convicting you.

"Possession" is a crime of access, not of ownership. You were driving the car, and it was under the drivers seat. You were, in the eyes of the law, "in possession" of it.

The only legal defence would be that you had no 'actual knowledge' that it was there.

This is where you find out how good a friend the car owner really is. If he mans up and says yes, it was his, and you had no idea it was there, then charges against you will probably be dropped.

If he denies it..... you're screwed.

i would force your friend into paying for every cent of all of your legal fees. i would go for it, i think it is good to question authority, it keeps them on their toes. take it from a politician's son.

If you're telling the truth, I'm with you. No intention to offend, but most deniers are liers. Not saying you are though, but hanging around friends that possess marijuana doesn't look to good on your record.

But, I think you have a valid case.
