I was given a catheter, by a C.N.A. who is NOT licensed to do so and injured...?

I went to the hospital (Waukesha Memorial) I was in the ER Department. A C.N.A. came in the room and made my lay down and began to try and put a catheter in me. Once it became very painful and I yelled out your hurting me. She never stopped, she just kept jamming the catheter in me. I then had tears coming down my face and I said I am already in pain. I looked at her badge as I tried pushing her off me, and I said your a C.N.A, your not suppose to be doing catheter's and she ran out the room saying she was going to get the doctor. Amber the Physician Assistant came in the room and I told her I was in a lot of pain and that the C.N.A. hurt me. She just told me to lay back. My girlfriend tried to come in the room because she heard me crying and Amber and the C.N.A. told her not to. I kept saying STOP. My doctor seen me 5 days later and said I have urethra damage and may need to go to a urologist. What should I do?

If the improper insertion of the catheter resulted in damages, then you may have a malpractice claim against the CNA. If she was instructed to perform a procedure that she was not certified to perform, then you may also have a malpractice claim against the facility.

EDIT.....No, you are not going to "get a million bucks out of it". Recoverable damages would be the medical bills for any doctors visits directly attributable to the improper insertion, plus an amount for pain and suffering - from a short term pain like this that is more likely to be hundreds of dollars than thousands.

I don't know what state you are in, but you need to contact your state's Department of Human Resources- 'Office Of Regulatory Services' to report this incident. You can also call the hospital's telephone operator on their switch board(main telephone line)and ask her to give you the phone number to the hospital's 'ombudsman'. You don't have to give the operator any identifying details about yourself; and if I were you, I wouldn't either. You can also try doing an internet search to obtain the phone number to the ombudsman & to learn more about what their job description is. Good luck!
