When I was 12, I was molested by a school teacher. He threatened to kill me if I told and I didn't turn him in until I was 14, but lied and said he kissed me on the school grounds (which he did) but I didn't tell about the molestation because I was afraid he would come after me again. But the school board just made him retire (he was 60 at the time).And I lived in fear for a long time. I know...stupid school board. But I finally told about the molestation after I confided in someone when I was 16. We have brought it up to law officials, but never per sued it too much.
I am 21 now. I want to sue the school board. DO I have a case? I have a lot of people that would testify against him, but no solid evidence.

A lot of time has passed and even though he should pay for what he did, do you really want to bring it all back to the surface?
It is all about you and what you will get out of it all in the end. It will become public and there will be a lot of negative attention toward you and him. I'm sure there are a lot of his victims out there and perhaps you'd be opening up a road for them as well. It is a tough call.
I had chosen to handle my childhood abuse by hiring a professional to help me know that I didn't do anything wrong.
Find a way for you to heal! Sadly, more kids then not are molested by a friend, relative or teacher so you certainly are not alone. This may sound harsh but you need to stop feeling sorry for yourself and move on. You can continue being a victim of this crime forever or find a way to move on and be a stronger better person. Everyone has great trauma in their life, yours is not any worse then any others.

Probably not. I was molested by my mother's boyfriend when I was 8, she found out about it when I was 19 and tried to pursue legal action.
Statute of limitations prevented it.
Check with your state, maybe their laws are different.. |

I will never understand why this was originally handled through the school board and not law enforcement... You MAY still have a case but, yoU need to get a lawyer....Seriously! |

Gees i feel for you. .Have you heard of a citizens advice bureau?? You should go see them and they can give you legal advice free of charge. I wish you all the best and hope that evil man gets all he deserves for putting you through soooo much.. GOOD LUCK |

you cant sue the school board
but you can go to the police station and press criminal charges against the teacher
happened here where i live alot
a case from 1983 was just charged in june and the teacher was charged |

I think that there is a bill that is trying to remove the statue of limitations on such future cases. But i say check it out & if you havent seen them yet Rape crises centers may provide help in the situation, they helped me allot. i think you will find them in the goverment pages of your phone book.good luck |

no, not the school board, they did nothing to you, they tried to help where they were needed, you need to see if you can put something against him personally, he is the one that did the crime, he needs to be the one punished. i think you do have a case, becase they do stuff like this all the time, i would ask your attorney, they will know. |

I'm not sure about this one, because you waited so long to bring it up. It's been almost 10 years since the incident, so I am not sure if what you say will hold up in court since it's been so long. Contact a lawyer and ask them, no one here will be able to give you a straight answer, as I'm sure none of us are sure. |

Talk to a family law attorney. A consultation should be free. Maybe do a little research in your area for attorneys who have advised and won cases similar to yours with the school board.
Unfortunately, it's going to be your word against his, but more than likely other victims will step up and confirm that you are not his first or last victim. The reason he was forced into retirement may become really obvious but you need some outside help.
You may need to just sue him and the school board's insurance will pay his settlement, you never know.

Nope not at all especially with what you have they will probably countersue you because your trying to take advantage of them. You could try but you have a slim chance of winning. |

Only if there is a witness or evidence I believe. I too had a similar case and I didn't have evidence and it's been hard but I've moved on with life and found 1 very special person to open up to, and pour all my pain in. I'm so sorry this happened. |
