Absolutely. Drunk or not, if someone damages your personal property they are liable. If they do not pay for the property through insurance or out of pocket, then I would follow through with a lawsuit if you think they can actually come up with any money. |

You can generally sue anyone you want. Whether or not you have a case is a different matter - and if your case doesn't meet the minimum standards in your jurisdiction, it will generally get thrown out of court.
Some things to consider:
Do you have insurance for the damaged property? If so, they can assist in helping you recover damages.
What is the overall $$ amount of the damages? If it's under certain threshholds, small claims court is where you would sue. Over those amounts, i would advise retaining a lawyer.
Can you prove who actually damaged your property? |

Yes. The other person's auot or property insurance policy will cover it. You should be able to go after this person and/or his insurance policy for damages. You should def. go for it. Drunk drivers need all the punishment they can get. If you not for their own good but as an example. Good luck to you. |

It would be a lot faster to just go through his auto insurance. It's called property damage. Get his insurance company's name and put in a claim. Or hers, girls drive drunk too. |

Yes, you'd go after his insurance company for the loss. Just call the company and send them a copy of the police report. They'll probably send an adjuster out to verify the damage, and get a price quote. Give them any receipts you have to prove how much you paid for it. If no insurance, then go after the individual, though that's probably almost pointless, if he doesn't have insurance and driving drunk, probably a big loser w/ no $. |

People usually have to pay restitution for the damages, alcohol related or not.

Yes, it was a negligent tort. And, you can get a lot out of his insurance company... they don't want to look bad for insuring drunk drivers. |

yes you can take hthat particular person to the civil court they will have to pay for you damages and may have to do time.. then maybe you'll think the drunk drive wont drive so drunk anymore once he pays a pretty penny. look at it this way.. you'd help to stop drinking and driving and you get some money off of it to repair you house. |
