I work nights and i'm not allow to leave the building were do i smoke?

i work nights for a large supermarket chain and i am not allowed to have a cigarette on my breaks as the nightstaff do not have a designated smoking area,but the day staff do.this does not seem fair to me as they have a secure yard that we could use.i just really wanted to know if this is against my human rights to be locked in the building for 9 hours without the same option to smoke as the day staff have?

my guess is that you should have the same rights as the day staff. i would of thought that your breaks were your own time.if you are on days you could go to the dentist ,doctors or go for a quick shop in your lunch hour without loosing pay .just because you work nights i can't see why you would not be allowed to leave for a smoke break as long as it's in your time.

Nope, you do not have a 'right' to smoke.

As I undersatnd it though, on your lunch break, you are unpaid and should be allowed to leave the building and smoke, they cannopt force you to stay in the building during time for which you aren't being paid.

It could be just an oversight by your management. This happened where I worked and it was sorted when we asked our managers about it.
As to be locked in a building for 9 hours, was it in the contract you signed when you got the job? If so you havent really got a leg to stand on because you agreed to it. If it isnt then you can leave whenever you choose.
Supermarkets tend to impose this for staff safety at night.
I am sure if you speak calmly to your manager soething will be sorted out for you.

Be smart, care about yourself and quit, take a cruise with the money you save on cigarettes.

contact AC AS - they have a website www.acas.co.uk. This does seem unfair to have one rule for day workers and one rule for night workers. Clearly, you are both no longer able to smoke on the premises but if one shift has access to a secure outside smoking area then the nightshift should do so too. Take it up with management. Are there other smokers that could unite with you. Many people would say give up but this is quite irrelevant here - it is one shift being given privilages that another shift does not receive.

If they were reasonable employer I don't see why if you speak to the boss, why they wouldn't make provision. Unfortunately though, I don't think employers are obliged to provide a place for their employees to smoke.

I would speak to someone at the union...

thing is your break time is UNPAID.. so therefore your own time. does it state on your contract you can't leave the building?

its human rights thing also.

if there's other smokers on nights, I'm sure they are the same?

bottom line is your not being paid for your breaks.. so its your own time.. i smoke outside in my car now at work..

Yes, it might be against your human rights, but then it might be against your human rights to be forced to work for this company. Oh sorry, its your choice to be there, and there is no legislation that protects smokers(as a minority) from discrimination.

Get a new job or switch to the day shift.

Usually a lock in situation at night is to prevent either theft of store merchandise or protect the employees against would be robbers. So either the store doesn't trust you or doesn't trust the general public.

If you can't go 9 hours without smoking then I guess its time to get a new job.

If your employer allows smoke breaks during the day, but not at night, he is breaking the law. In the UK, we have Equal Opportunities... See your union rep..

Usdaw is a good starting point if you are not in a Union.

I think you will find the same applies to air travellers. If you fly from London to Spain you are allowed to smoke after about 2 hours, whereas if you fly to Australia you have to wait at least 12 hours.

That, too, is clearly discrimination and someone should do something - perhaps have an outside smoking area on flights to Oz.

Why does everyone think they have a right to smoke? I like drinking alcohol, but strangely was not allowed to drink alcohol at work.

There are two VERY simple answers - get another job, or quit smoking.

I am sure your employer will be happy to get rid of you so you can "smoke" on your time. Isnt this something they would have mentioned to you when you took the job? It would be at night, you would be locked in? No smoking inside?

But also this would be a great opportunity to break the habit.

I am out of work, I smoke also, but I would GLADLY take your job in a heartbeat and NOT smoke for those 9 hours, to make my house payments on time. There's something to think about.

They can get away with it, if you kick up a fuss they just employ someone else. Thats why you should learn a trade and be your own boss, no one can tell you nothing then!
