Yes. When you walk out of the door of a store with an item you know you didn't pay for, you stole it.
If the cashier didn't scan an item, and you didn't notice, you didn't break the law because theft requires "criminal intent". However, if you DID notice that she didn't scan it, and you leave with it anyway, then you did have criminal intent, and you stole it.

er . . . how does your conscious feel? i would feel guilty. a cashier at tj maxx forgot to ring my glasses in richmond. I didn't go back to richmond for a couple of months, but when i went back, i returned and paid for them. guilt was eating me. |

As far as something not being considered theft if it is in plain view. I don't know if that is true or not, but that is why in some stores there are people at the exit that check receipts. Some people go into a store, put things in a cart and walk out the door. I can't belive that they don't get prosecuted when they get caught. |

It's all about what would get you convicted in a Court of Law should you ever get caught.
In the eyes of the Justice System, is if you knowingly and willingly take possession of any form of property without paying for it - and payment was required to obtain the property legally - then you have, accoring to the law, stolen that property.
It doesn't matter whether or not the cashier didn't ring up the items or didn't see them. It is your responsibility to ensure that you only leave with what you obtained legally - by paying for it. What your concience tells you is an entirely different thing. Your concience won't convince a Judge that you didn't break the law if, one day, a Vendor ever notices you doing it and decides to prosecute. |

In my morality, taking anything I didn't pay for is stealing. I don't do it. You make your own decisions. I have found in life, it's a good policy to not take posession of anything you didn't pay for. Period. |

Yes. Here's why...because you KNEW the item was not scanned. All you have to do, is bring in your sales slip, or stop the transaction and say, 'Excuse me, did you scan this item, (ma'am, sir)? They can stop, and check the receipt right then and there and correct the situation.
Now and then, we have all gotten a 'freebie', but usually it happens because neither we nor the clerk caught the error.
You have caught the error, and didn't say anything, so Yes,
you are a thief. Next time you are in the store, watch that all items are scanned and question any that might not have been.
It's not just the theft angle, what if they double scan an item? What if they charge too much because a sale item was not marked down in the computer that links the register?
So just as you may cheat the store, the store may be cheating you. Always check your totals as items are scanned, pay attention to prices of items, especially those marked on sale.
Learn from this, and do better next time. |

Yes, that is stealing and you can be charged with a crime.
You know you did not pay for those items, you knowingly took those items and de-frauded that company or someone. You can't say "well they forgot to chagre me". |

Yes you are. You are cognitive to the mistake and say nothing on purpose. It is the same as if you watch a man drop his wallet and walk away. you then run up and take the wallet and clean him out.
You notice something and it is up to you to point it out and not take advantage of that person's mistake. |

yes, if you took it without paying,you are stealing.And if you really feel guilty you should say to the cashier that he/she forgot to charge you for it and you can buy that thing instead of stealing it. |

you know legally if you walk out of a store holding an object you didn't pay for but is in full view, you can't be prosecuted. Your case is a grey area but it's most definitely dishonest, plus the cashier could get in serious trouble. Who knows how many times they've done this |

Yes it is. I know how you feel. I had a different situation happen once. The bagger forgot to put one of the bags in the previous customer's cart and when I got home, I realized I had groceries I hadn't paid for. There were like 5 items, I felt really guilty but didn't feel like going back to the store, because it was late, and I wanted to return instead of pay for, as it was stuff I didn't really want, and I didn't know if they would take back the produce. That was like 3 years ago and I still feel guilty. |
