If Arizonans could legally pass a law encouraging racial profiling, do you think they would?

I've read the current law, I know it prohibits racial profiling (which it didn't need to do since that is already unconstitutional, but understand public affairs was needed).

But, if Arizonans could pass a law implementing wide racial profiling for all crimes (with no public or legal backlash) do you think they would?

To clarify: I did not say the law was Constitutional or unconstitutional. Racial profiling is unconstitutional which is why 'prohibiting racial profiling' in the Arizona bill was unnecessary, because police couldn't do it anyway. That's the way the 14th Amendment works.

How is it unconstitutional??? It dumbed down the Federal Law, which allows racial profiling and requesting documents without a reason. The Fed Law allows a cop to ask for ID and proof of citizenship without a cause.....the Az law requires a justified reason, such as being pulled over etc.

If the Bill was in fact uncosntituitional it would be at the supreme court already, its only 10 pages long, a law student can rip it apart in a few hours...can you imagine a legal team fromthe White house? If it isnt sent to the Supreme Court by now its because it is not unconstitutional.

I`m just curious since you claim to have read the Bill and you know that it in fact states racial profiling is prohibited what part of the bill is unconstitutional? Can you answer that?

I mean AG Eric Holder claimed the same thing but at least he admitted to not even reading the bill.

You also realize that even the Hispanics of Az support the bill overwhelmingly so.

You made it sound like there was no need to clarify on racial profiling sicne other parts of the bill were unconstitutional....
But it was necessary to clarify that part of the Az bill because if there was any question they can deem the bill unconstitutional because they can interpret it as racial profiling, which is unconstitutional....which is also why your second question is moot....racial profiling is unconstitutional so if they did pass a law allowing it the feds would send it to the supreme court and they would instantly overturn the racial profiling law

Obviously if they repealed the anti racial profiling amendment then obviously the people will be for it..if the govt accepts it and the people accept it why wouldnt they accept a bill? Your question answers itself

No and people should quit calling it race because it is not race but illegals from another country, and they are not just one race but several races so it is just a ploy by the protesters to gain help from our political minded government who have sold out to mexico

It does not encourage racial profiling. that is a bunch of crap. The law is not unconstitutional. How is a law against ILLEGAL immigration unconstitutional? The Federal Government wont do their job so Jan Brewer stepped up.It says in the law that racial profiling is not allowed and they will not tolerate racial profiling. If people are legal then they have nothing to worry about.

Yes.
The average voter in the region (not just Arizona) is incredibly biased against Mexicans. Most peole don't cross the line into racism, but they honestly believe that illegal Mexicans cause most (if not all) of the crime in their area, overburden the hospitals and schools while not contributing to the tax base, and generally bring down the quality of life for everyone else. I'm not saying that this is right or wrong, just that it is what the average voter believes in many of the southwest border states.

They would see a racial profiling policy as a logical reaction to these problems. As a way to specifically target the group that they think is messign everythign up.
