If I shot someone with their own gun, would I get in trouble?
|
I was wondering like if there were to be someone who points a gun at my face in a public resturant or something and they wanted my wallet. Then out of self defense, I grab their gun and knocks him out and he gets up and trys to hurt me, then I use his gun that i took from him to shoot him on the leg or whatever out of self-defense; could i get in trouble? And remember this is in public too.

It wouldn't matter if it were his gun or not. Self-defense is self-defense. We had a similar incident here last year, only it was inside someone’s home. Some burglars invaded an elderly man’s home and he was able to wrestle the gun out of one of the guy’s hands and then shot him with it. The burglars fled, even the one that was shot, and was later picked up by the police. There were no charges pressed against the elderly man for defending himself. |

Wow. Intense scenario.
It would depend on the state, I'm sure, but most prosecutors would most likely look at this situation as one of self defense and would not prosecute. This wouldn't save you from a civil lawsuit being filed on behalf of the defendant, though.
Just as a precaution, though, I would try to refrain from shooting anyone in public (or private), regardless of whether you were trying to protect yourself or not. It just tends to make life a bit easier. |

Probably not but im not sure because if you shoot him like did you kill him or just injure him and if there is a lot of witness then you would probably fine also it was self defense i guess it's what happens in court and how good the lawyer is to the defense i guess |

Yes, well that's considered using excessive force and probably would land you in jail on charges of criminal battery with a deadly weapon.
Not a good idea pal. You can knock the guy out, take his gun. You can't just shoot an unarmed assailant. |
