Well, shouldn't really be a matter of if you "have to" to be honest. More like should.

In Canada, yes you do have to report, but I don't think anyone ever gets charged with obstructing justice for now doing so. If you fail to report the murder because you want to protect the murderer, it is aiding and abetting.

Maybe a better question would be "should I?" instead of "Do I have to?" To my way of thinking, it is your duty as a citizen to report crime.

The following post is from a student of law. It is not legal advise. Anytime crime is involved you always get a experienced criminal lawyer. ALWAYS. this is serious stuff and you are never given a chance to go back and change what you said to the police or anyone else.

TEXAS PENAL CODE (CRIMINAL LAW)
Generally, failing to report a crime, like any other failure to act, is not a crime unless a specific law "provides that the omission is an offense or otherwise provides that he has a duty to perform the act." Tex. Pen. Code § 6.01(c).

Each state varies for crime law. The above is law for Texas.

However, once you are questioned by police about ANYTHING no matter how insignificant, ask "am I free to go". If, they say yes, then leave and find legal advise. If they say no, demand a lawyer; it is your constitutional right. It wont hurt you to ask for this. It could hurt you if you don't.

If they say "you dont need a lawyer", then you should be free to go unless you are under arrest and then of course you do need a lawyer. The police are never on YOUR SIDE during questioning. NEVER EVER.

Remember anything you say can be used against you even without a miranda warning. Durng casual questioning, what ever you say will be used. Miranda warnings are for after arrest.

ALSO, Remember, this casual questioning can become dangerous for you. If you say anything that can link you to the crime or people who the police "think" did the crime you will spend time in jail. Even if you are COMPLETELY innocent.

Police and District Attorneys are under intense political pressure to "solve" a case. The longer it takes the worse it looks for the whole department.

The jails and prisons full of innocent people.

If you are skeptical visit http://www.innocenceproject.org/ and see the list of innocent people who spent 10, 20, 30 years in prison for crimes they did not commit. There are over 110 released so far. This list is growing.

AND The police can not always protect you when you become a witness.

Hmm. If you just see it and the guy takes off and you happen to know who it is, no. You're just a bad citizen.

However, if the guy knocks on your door and says "I did it, I know you saw...PLEASE don't tell" and you agree, then you're getting into the murky area of being an accessory.

Why wouldn't you? You're obstructing justice if you don't. You can even do it annonymously, that's better than just keeping quiet. It's your job as a citizen to report when harm is done to another.

If you witness a murder, then OF COARSE REPORT IT!!! But if it was more than what it seemed, I'd tell a special agent so it doesn't have another person killed, because you can trigger the killer to kill another.

Yes, its the law for the sake of the victim, and to prevent any danger to others in society. This is pretty much common sense.
