Just threatening them with legal action might get you a new phone out of them. They should definitely get you a new one but it will be a hard battle. |

Kate

I would say yes to that...they have the right to take that stuff away if it is being used against the rules...but because you own it they have no right to keep it and definetely no excuse for losing it...they owe you a new one |
|

Susan B
|
YES THEY SHOULD. that really pisses me off. they owe you a cell phone. |

the teacher probably thought you had it on, and thats why they took it. but if they lost your phone, then they should definitely pay for it. |

i think they should. espescally cause they took it 4 a bad reson. |

Yes...when they take your property...they are responsible for what happens to it |

Yes! Tha's crazy and the school definitely needs to pay for that. Take it to court. No I was kidding, don't, it's a waste of money. Just have your parents talk to them and try to work something out and if that doesn't work get the media involved and they'll be obligated to buy you a new one. |

Yes they are liable for the phone......and have to pay you for it, call an attorney or have your parents call the principal and demand payment.,,,the teacher lost it, so the teacher is liable, the teacher is employed by the school board and therefore making the school district liable for the teachers actions....

I would say YES. That is ridiculous. I hate schools. Thank God I've been done for 5 years. |
|

Dani
 |
Yes they should pay for it |

They should have given you a reciept for the phone, but that depends on your district policy. You need to have your parents go up there and talk to the principle and raise hell. |
|

Heck yeah they should pay for it!
They're supposed to keep it in safe keeping,
and give it back to you.
If they took it and intended to give it back,
they should follow through. |

phantom.obsession

hell yes, especially if it was off.
that's just irresponsible. seriously, that's ridiculous that they would lose that. don't trust that school. |

I would talk to the principal of your school and get your parents involved and find out what can be done about it. If you do nothing about it then nothing will happen, so talk to anyone you can at the school about the issue and see if there's something they can do. |

I think they should have to replace it. That's stupid. My sister takes her cell to school all the time and it's the same rules as where you are. As long as it is off it's fine. You should talk to someone to find out what you need to do to get them to pay for it. I'm sorry! Good Luck! |

Lemon Paper

Yea. Of course they need to get you the same phone new. Sounds like something my school would do. We aren't even supposed to have cell phones in class at all but people still text in class. |

yeah they should pay for it. lucky they dont lose u lot kids eh lol |
|

madds
 |
i believe they should |
|

PinkLady

YES, irregardless of why it was taken, if it is lost then they are liable to pay to replace it.
or The teacher who took it may be held responsible for it. |

The school lost it and should pay for it. You may have to file a claim with the school board or get legal counsel. Talk to the principal or have your parents do it. They may make a more serious impression. You may want to sue the teacher that actually took posession of it from you since you probably have eye wittnesses to state that fact. |

Fisrt off, phones don't fall out of pockets. Second thing is that you need to look up the meaning of entitled. Third is more of a clarifacation of your question; but what good is a cell phone if it is off. What you telling us here is that you where lugging aroung a cell phone for no reason, that was off. Then phone then just fell from your pocket without any help from anything but gravity! Lets try a little bit of common sence here instead of your fiction. A) You were using your phone and came up with this lame story for your parents as to why it is gone after it was taken by the teacher. B) You lost the phone and again came up with the gravity defying phone story. Either way, you need a better story. I am no super slueth and I know that something is amiss with your work of fiction. Good luck! |

If I was in a similar situation I would ask nicely at first for my phone back. Then bring your parents into it, ask your cell phone company for what they think you should do. Talk to your Principal and explain the situation. A cell phone is an important part of people lives in this day and age. You should be able to get your cell phone back or replaced. |

I would learn how to spell school, before I tried to sue anyone. |

HI
NO THEY DON'T BECAUSE SCHOOLS HAVE RIGHTS TO CONFISCATED YOUR CELL PHONES EVEN IF THEY LOSE IT. I THINK IT'S TOO BAD! THEY AREN'T RESPONSIBLE IF THEY CONFISCATED AND LOOSES IT! |

The only thing they owe you is an education but you are too entitled and pathetic to actually bother to learn. I doubt it just fell out and I'm fairly sure you are lying about all the details. You lost it, grow up and take responsibility. |
|

first, you must prove to them or show evidence that it was all a misunderstanding. you were just picking your phone up and you were not using it. if you can prove that, you would be innocent and maybe you can ask the school to take responsibility. of course, this cannot be done if the school does not allow bringing cellphones. however, by asking them to take responsibility (paying for it), you might end up having a conflict with your teacher so please be careful. |

You should check on it. Our school is okay w/phones that are off but they also have to be out of sight at all times. If that is the case, it's your fault for not being more careful with it. If this is not the rule, I'd definitely inform your parents and get them involved. |
